Rules of purchase and sale in the e-shop "zuklevilkijoje.lt" 

1. General provisions 

 1.1. Terms used in the Rules: Buyer - a natural or legal person purchasing goods or services in the electronic Store, who may enter into purchase and sale transactions in accordance with the applicable legal acts of the Republic of Lithuania. The seller is UAB Vilkijos prekyba. Zuklevilkijoje.lt is an electronic store of the goods and services company of UAB Vilkijos prekyba. Seller's Marketplace - Seller's Marketplace in Degalinės st. 1, Jaučakių km, Vilkija, Kaunas district. 

 1.2. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”) are a legal document setting out the rights and obligations of the Buyer and the Seller, the conditions of purchase and payment for goods, delivery and return procedures, liability of the parties and other .lt ”e-shop related provisions. 

 1.3. By agreeing to the Rules of "zuklevilkijoje.lt" (after getting acquainted with the Rules and checking the box "I have read and agree with the rules of" zuklevilkijoje.lt "), the Buyer confirms that he has the right to purchase goods in the" zuklevilkijoje "e-shop.

1.4. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts. 

 2. The moment of concluding the purchase-sale agreement 

 2.1. The Purchase and Sale Agreement between the Buyer and the Seller shall be deemed concluded from the moment the Buyer orders the goods in the e-shop, indicates the delivery address, chooses the payment method and reads these Rules, and is valid until the full fulfillment of obligations under this agreement. In cases where the Buyer does not agree with all or part of the Rules, he must not place an order. 

 2.2. Each contract concluded between the Buyer and the Seller is registered and stored in the "zuklevilkijoje.lt" database. 

 3. Buyer's rights and obligations

3.1. The Buyer has the right to purchase goods in the zuklevilkijoje.lt e-shop in accordance with these Rules and the legal acts of the Republic of Lithuania. 

3.2. The Buyer has other rights provided for in the Rules and legal acts of the Republic of Lithuania. 

 3.3. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules. 

 3.4. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller about it by the means of communication specified in the "Contacts" section. 

 3.5. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately. 

 3.6. By using the "zuklevilkijoje.lt" e-shop, the Buyer undertakes to comply with these Rules, other conditions clearly indicated in the e-shop and not to violate the legal acts of the Republic of Lithuania.

4. Seller's rights and obligations 

4.1. If the Buyer tries to damage the operation, stable operation or security of the e-shop "zuklevilkijoje.lt" or violates its obligations, the Seller has the right to immediately and without prior notice restrict or suspend his use of the e-shop or in exceptional cases cancel the Buyer's registration and related losses of the Buyer.

 4.2. In the event of significant circumstances, the Seller may temporarily or indefinitely terminate the operation of the e-shop without prior notice to the Buyer and shall not be liable for any related losses of the Buyer. 

 4.3. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen payment by transfer, does not pay for the goods within 3 (three) working days. 

 4.4. When the Buyer chooses the method of payment in cash when picking up the goods at the Seller's market, the Seller shall contact the Buyer by phone or e-mail specified in the order in case of any doubts regarding the information provided in the order. In this case, the term of delivery of the goods starts from the day of contact with the Buyer. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Seller fails to contact the Buyer within 3 (three) business days.

 4.5. The Seller has the right to unilaterally change these Rules by publishing the amended Rules on the e-shop website. The amendments take effect from the moment of publication for all transactions concluded after publication. 

 4.6. The seller may refuse the transaction if he has data or suspects that the transaction is being carried out illegally. 

 4.7. The Seller undertakes to enable the Buyer to use the services provided by the e-shop "zuklevilkijoje.lt" under the conditions set forth in these Rules and the e-shop.

 4.8. The Seller undertakes to respect the Buyer's right to privacy of personal information belonging to him, specified in the e-shop registration form, except for the cases specified in the laws of the Republic of Lithuania and Chapter 10 of the Rules on Personal Data Protection.

4.9. The Seller must deliver the goods ordered by the Buyer to the address specified by the Buyer within 7 (seven) working days from the date of ordering the Goods or according to a separately agreed delivery period. 

 4.10. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept a similar or most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if the advance payment has been made. 

 4.11. If the Buyer delivers a defective, defective or transported damaged product and returns it, the Seller undertakes to return the money paid to the Buyer within 10 (ten) working days from the date of receipt of the returned product. 

 4.12. The Seller shall not be liable for any losses of the Buyer related to malfunctions of the e-shop and (or) data transmission errors. 

 6. Payment for goods 

 6.1. The prices of the goods in the e-shop and in the formed order are indicated in Litas and Euros in accordance with the legal acts of the Republic of Lithuania. 

 6.2. The buyer can pay for the goods: 

 6.2.1. Bank transfer; 

 6.2.2 In cash at the Seller's market. 

 6.3. When paying 6.2.1. and 6.2.2. the methods of payment provided for in clauses, the Buyer undertakes to pay immediately. Only after the Buyer has made the payment and credited the money to the Buyer's bank account or cashier, the formation of the consignment of goods begins and the term of delivery of the goods begins to count. 

 6.4. When the buyer places an order, in the "order history" section the buyer sees all his orders and can print a prepaid invoice. When the Buyer's order is completed, a VAT invoice will be sent to the Buyer at the e-mail address provided during registration, which will also be provided with the item (s). Invoices indicate the goods selected, their quantity, the discounts granted, the final price of the goods, including all taxes, and delivery charges.

7. Delivery of goods 

 7.1. When ordering goods, the buyer can choose the way of presenting the goods, i. to use the home delivery service provided by "vilijosprekyba.lt" or to pick up the goods at the Seller's market. 

 7.2. Delivery of goods to the Buyer: 

 7.2.1. The goods are delivered by the Seller's authorized representative. 

 7.2.2. The buyer, having chosen the home delivery service at the time of ordering, undertakes to indicate the exact address of the place of delivery: street, number, postal code, city, county, as well as telephone number and e-mail address. 

 7.2.3. The Buyer undertakes to accept the goods himself or to inform the Seller about the persons who can accept the ordered goods. In case the goods are delivered to the specified address and based on other data provided by the Buyer, but the Buyer or its designated persons cannot accept or refuse to accept the goods, the goods are handed over to the Seller's authorized representative's terminal Storage of goods at the terminal may be subject to additional charges. 

 7.3. Pick up of goods at the Seller's market: 

 7.3.1. The buyer can pick up the goods free of charge at the Seller's market Degalinės gt. 1, Jaučakių km, Vilkija, Kaunas district .. 

 7.3.2. The ordered goods must be picked up no later than within 5 (five) working days, counting from the day of sending the notice about the prepared order to the Buyer. The notice is sent to the Buyer by e-mail. A storage fee may be charged for the 11th (eleventh) day and the following days. 

 7.3.3. The goods can be picked up only by the person who placed the order or the person specified at the time of placing the order. When picking up the goods, when they have been paid for by advance order, it is necessary to have a valid identity document (identity card, passport or a new model driving license) with the Seller's employee. When picking up the goods, you need to know the order number, the customer.

7.4. The Seller shall deliver the goods to the Buyer within the terms specified in Section 4.9. When the ordered goods are missing in the Seller's warehouse at the time of ordering, the delivery term is coordinated separately. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery. 

7.5. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control. 

 7.6. At the time of delivery of the Goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the consignment and the product (s) and sign an invoice, bill of lading or other delivery-acceptance document. The Seller is released from liability against the Buyer for damage to the goods, if the cause of such damage is not a factory defect. 

 7.7. More detailed information related to the delivery of goods is provided in the section "Delivery methods" of "zuklevilkijoje.lt". 

 8. Goods quality guarantee and return conditions 

 8.1 The Buyer understands that the parameters or shades may differ from the actual ones due to the characteristics of the monitor used by the Buyer, as well as the improvement and change of the manufacturer's technical parameters, therefore the Seller is not responsible for this. 

 8.2. The goods are covered by the manufacturer's warranty, if applicable and specified in the product description. If the Seller does not provide a guarantee, the legal acts of the Republic of Lithuania regulating the guarantee shall be followed. 

 8.3 In accordance with Directive 97/7 / EC of the European Parliament and of the Council, Due to consumer protection in connection with distance contracts, the Buyer is not entitled to exercise the option to withdraw from the contract if the acquired quality goods were manufactured according to the Buyer's special instructions or are clearly tailored to a particular Buyer (consumer). 

 8.4. When the wrong product and / or defective product is returned, the Seller undertakes to pick up such goods (the Buyer delivers them to the Seller's market) and replace them with similar suitable goods. In the event that the Seller does not have similar goods, he shall return to the Buyer the money paid for the goods.

8.5. In all cases, the money for the returned goods is transferred only to the bank account specified by the Buyer in the electronic return application. If the product is of poor quality: In case you have noticed that the product is of poor quality, you have the right to return such product to us within 3 (three) working days from the date of delivery to you. In this case, we undertake to exchange the defective product for a quality product free of charge or to return the money paid to you. 

8.6. The following conditions must be met when returning the goods: The returned product must be in the original neat packaging, the product must be undamaged and unused by the Buyer; The product must not have lost its commercial appearance (undamaged labels, peeled protective films, unfilled fuel and lubricants, etc.); The returned goods must be in the same configuration as received by the Buyer; When returning the goods, it is necessary to present the document of its purchase, the warranty card, which was issued and the completed return document (free form, what is returned, the reasons for return); 

 8.7. It is agreed that goods that are not in stock and have been ordered specifically for a separate order from the manufacturer cannot be returned. 

 9. Liability of Buyer and Seller 

 9.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences and acquires the right to claim compensation for direct losses incurred by the Buyer.

9.2. The buyer is responsible for his actions performed using this e-shop. 

 9.3. The buyer is responsible for transferring his login details to third parties. If the services provided by zuklevilkijoje.lt are used by a third party who has logged in to the e-shop using the login details of the Buyer, the Seller considers this person to be the Buyer. 

 9.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the Seller's recommendations and its obligations, did not read these Rules, even though he was given such an opportunity. 

 9.5. If the Seller's e-shop contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons. 

 9.6. In the event of damage, the guilty party compensates the other party for the direct damage. 

 10. Protection of personal data 

 10.1. In order to order goods in the e-shop "zuklevilkijoje.lt", the buyer can register on this website by entering his registration name and password, or buy as a "Guest", indicating the information required in the payment form. By confirming these Rules, the Buyer agrees that the e-mail address and telephone number specified by him will send the information notices necessary to complete the order of goods. 

 10.2. By selecting "Yes" in the "News Subscription" field, the Buyer agrees that his data will be processed for direct marketing purposes. 

 10.3. When ordering goods, the buyer must provide his / her personal data necessary for the execution of the order: name, surname, delivery address, telephone number and e-mail address. The Seller confirms that these data will be used exclusively for the sale of goods in the e-shop "zuklevilkijoje.lt" and for direct marketing purposes, if the Buyer's consent has been obtained in clause 10.2. The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners providing delivery of goods or other services related to the proper execution of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.

10.4. Upon receipt of the ordered goods, the Buyer's identity document submitted to the Seller's representative and the Buyer's data contained therein shall be used only for proper personal identification. 

 11. Sending information 

 11.1. The Seller sends all notifications to the e-mail address and / or telephone provided in the Buyer's registration form. 11.2. The Buyer shall send all notifications and questions to the e-mail address specified in the "Contacts" section of the Seller's e-shop. 

 12. Final provisions 

 12.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania. 

 12.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these Rules. 

 12.3. If the Buyer does not agree with these Rules, he / she cannot use the services of the "vilijosprekyba.lt" e-shop. 

 12.4. All disputes arising out of or in connection with the implementation of these Rules shall be settled through negotiations. If no agreement is reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
